DETAILS OF THE CASE
The incident occurred on January 27, 2023, when the victim, who has been granted anonymity due to a gag order, was at the hospital’s ambulatory ward preparing for right shoulder surgery.
According to Deputy Public Prosecutor Ethan Lee, Danisha approached the victim under the guise of checking his vital signs. He drew the curtain around the victim’s recliner chair, lifted the patient’s hospital gown, and inquired if the victim was wearing underwear, which the prosecution argued was an attempt to gauge the victim’s reaction to his inappropriate behavior.
While Danisha placed a blood pressure cuff on the victim’s arm and activated the machine, he inappropriately pressed against the victim’s private parts three times, asking if the victim felt any pain.
Initially, the victim believed this behavior was part of standard medical procedure, but later discussions with other staff members revealed that it was not typical practice.
Mr. Lee highlighted that Danisha’s actions were calculated, as he sought to conceal his misconduct by drawing the curtain and framing his actions as part of medical care.
In his defense, Danisha denied all allegations, claiming he merely approached the victim to take vital signs and did not fully draw the curtain or engage in any inappropriate touching. He suggested that the victim fabricated the accusations due to “homophobia” and implied that his own LGBTQ identity influenced the situation.
The prosecution sought a sentence of 15 to 18 months, citing aggravating factors such as Danisha’s abuse of his position of trust and his use of deception to perpetrate the crime.
The victim described the experience as “shocking” and “unexpected,” expressing feelings of shame, discomfort, and unease afterward.
Under the law, Danisha faced a potential sentence of up to three years in prison, along with fines, caning, or a combination of these penalties.
