DETAILS OF THE CASE :
Nguyen, a Vietnamese national, pleaded guilty to one count of performing an obscene act in public, while Ching, a Singaporean, pleaded guilty to abetting her. They each had an additional charge related to Nguyen appearing nude in public taken into consideration for sentencing, according to Channel News Asia.
The court learned that Nguyen regularly livestreamed on TikTok and a Vietnamese gaming app known as MMlive. On September 27, 2024, she decided to take up a challenge from her viewers to livestream sexual acts in public while dressed skimpily in exchange for money. At around 1:17 PM, Nguyen donned a translucent dress and positioned herself at the void deck directly in front of a lift. Using a mobile phone on a tripod stand facing her, she danced and performed several obscene acts.
A 32-year-old man, who witnessed the acts, contacted his wife. The couple recorded Nguyen as evidence, and one of them subsequently called the police. Nguyen later changed into an equally revealing kimono that exposed her private parts as she moved around, continuing to perform indecent acts in full view of the public. Meanwhile, Ching sat beside her, keeping a lookout to ensure there were no interruptions.
The police arrived at approximately 3:09 PM and arrested Nguyen. In court documents, the prosecution highlighted that the incident took place on a work and school day, noting that children could be returning home during that time. The void deck was described as highly accessible, visible, and frequented by many pedestrians.
Initially, Nguyen denied performing any obscene acts, claiming she was only dancing “in a sexy way” while livestreaming. However, she admitted to the obscene nature of her actions in a second statement when confronted with video evidence. She insisted that she “revealed only a bit” despite being almost nude, as stated by Deputy Public Prosecutor Esther Lim.
Ching similarly denied the acts, asserting that both he and Nguyen were fully clothed and argued that performing sexual acts while fully clothed should not be considered obscene. He also suggested that Nguyen had accidentally exposed herself.
The prosecution sought a sentence of three weeks and three days’ jail for each accused.
DPP Lim emphasized the public nature of Nguyen’s actions, stating that residents returning home were “forced to walk past her and be exposed to her obscene act.”
She remarked that Nguyen “effectively manufactured pornography in a public place.”
During mitigation, Ching expressed remorse, stating, “From the bottom of my heart, I apologise to court and the people of Singapore. We recognise our mistake and we are very remorseful for our actions.”
He added that his family had been under “tremendous stress” due to media coverage of the incident.
Ching noted that the psychological stress and suffering experienced by his family exceeded the punishment of a jail term, affecting his career and future. He requested leniency from District Judge Jasvender Kaur.
He requested District Judge Jasvender Kaur for leniency and compassion rather than a jail term, according to the report.
Nguyen, speaking through an interpreter, cited financial difficulties and her responsibility to support a teenage daughter in Vietnam. Ching also requested a gag order to protect their identities for the well-being of his mother and to “protect the dignity” of Nguyen, but the judge declined.
In delivering her sentence, Judge Kaur acknowledged the extended duration of the offences and the accessibility of the location. She concluded that the offences warranted a jail term.
An offender convicted of committing an obscene act may face up to three months in jail, a fine, or both.
