Two foreign workers, Alam Foysal, 38, and Ahmed Rayhan, 32, have been involved in a shocking case of sexual assault that occurred during a late-night MRT journey in Singapore.
The alleged incident, which took place on March 8, 2022 according to a report by ST.
DETAILS OF THE CASE
According to the prosecution, Foysal led a heavily intoxicated 32-year-old woman from the train at Tuas West Road station into a grassy area beneath the Tuas Viaduct, where he allegedly raped her. Rayhan followed closely, making repeated, unsuccessful attempts to assault the victim himself.
The victim was discovered the following morning by a passer-by who noticed her curled up on the ground, partially undressed and bleeding from the head. He immediately contacted the police, who launched an investigation into the incident.
Foysal and Rayhan, both Bangladeshi nationals working as welders on the same construction project, had been drinking with a mutual friend before boarding the train just past midnight.
They boarded the train at Chinese Garden MRT station.
They encountered the victim, who was behaving erratically and not responding coherently to their attempts at conversation during the journey.
“She was heavily intoxicated and behaving erratically – walking up and down the aisle, sitting on the floor and then standing up” the report said.
Upon reaching Tuas West Road station around 12:30 a.m., the men decided to help the visibly intoxicated woman. Foysal guided her out of the train and suggested to station staff that she lived nearby and they were merely escorting her home.
After leaving the station, he led her to an isolated field, as per the report.
In a dark area beneath a concrete pillar, Foysal allegedly began to unzip his trousers while Rayhan molested the victim. The prosecutor stated that after witnessing Foysal rape the victim, Rayhan attempted to do the same but eventually gave up after several unsuccessful tries.
Foysal then raped the woman a second time before both men returned to their dormitory in a taxi.
Surveillance footage and DNA evidence played crucial roles in identifying and arresting the two men later that day. Rayhan was arrested at 6:20 p.m., while Foysal was arrested shortly after at 7:05 p.m.
During the investigation, DNA testing revealed Foysal’s semen on swabs taken from the victim’s body, while Rayhan’s DNA was found on the interior of his jeans, further implicating them in the assault.
Rayhan was initially charged with rape, but the charges were later amended to attempted rape after a final determination on August 16, 2023.
During the sentencing, the prosecution requested a term of eight to ten years in prison, saying that Rayhan was fully aware of the victim’s incapacity to consent and exploited her vulnerable state.
On October 18, Rayhan was sentenced to nine years’ imprisonment and nine strokes of the cane after pleading guilty to a charge of attempted rape. During sentencing, the court noted that two additional charges related to the same victim—one for sexual assault by penetration and another for outrage of modesty—were taken into consideration.
Rayhan’s lawyer, Mahadevan Lukshumayeh, expressed that his client “made the biggest mistake of his life” by succumbing to temptation. The case continues to unfold, with Foysal’s own charges still pending in court.
