A 43-year-old man, Helmy Aman Subari, has been sentenced to six years in jail for sexually assaulting a young girl two decades ago.
According to the report, he pleaded guilty to one charge of having carnal intercourse against the order of nature, with three similar charges taken into consideration during sentencing.
The offences took place between 1999 and 2002 when the victim, whose identity has been protected, was between five and eight years old.
Helmy was around 19 to 22 years old and serving his national service, the report said.
The victim and her elder sister were being looked after by their mother’s close friend, Helmy’s mother, who was paid between S$400 and S$450 to care for them.
The sisters would spend weekdays at the Helmys’ flat.
BLINDFOLDED THE VICTIM
On the day of the incident, Helmy blindfolded the victim and sexually assaulted her by using chocolate on his genitals and placing it in her mouth. Feeling uneasy and suspicious, the victim expressed her discomfort and left.
Despite no longer living at Helmy’s flat, their mother continued to bring the sisters for regular visits.
The victim, only realized what had happened to her after attending sexual education classes in secondary school. She was diagnosed with post-traumatic stress disorder (PTSD) and continues to suffer from invasive memories triggered by chocolate snacks, nightmares of Helmy, and other symptoms.
According to court documents, she was “very disgusted and traumatised” upon realizing what had happened, and her anger towards the accused grew as the memories of the abuse continued to haunt her. She filed an online police report on June 29, 2022, alleging that she and her sister had been sexually abused by the accused while they resided in his flat. Details of her sister’s abuse were not disclosed in the court documents.
The victim, who is now a mother to a nine-month-old daughter, decided to report the abuse to ensure that the world is a safer place for her child. She mustered the courage to file a police report in June 2022, leading to Helmy’s arrest and subsequent sentencing.
During the court proceedings, Helmy’s lawyer, S S Dhillon, stated that his client regrets his actions and accepts the consequences of his “morally reprehensible” behavior.
“He regrets his foolish actions and accepts the consequences of his morally reprehensible actions,” said the lawyer, who noted that his client never reoffended in the decades that passed after the offence.
“That is why I said in mitigation that he cannot comprehend why he did so at that material point in time. It’s not his usual behaviour,” said Mr Dhillon according to the report.
Despite having the opportunity to challenge the charges due to the length of time that had passed since the offences were committed, Helmy chose to plead guilty at the first opportunity.
District Judge Kenneth Chin remarked that a substantial jail term was warranted given the nature and circumstances of the offense against a young victim who continues to suffer from PTSD as a result of the abuse.
The offense of having carnal intercourse against the order of nature carries a maximum penalty of life imprisonment, or a jail term of up to 10 years, and a fine.
